Abstract
Svako suvremeno demokratsko društvo treba težiti uvažavanju ljudskih prava i sloboda, među koje spada i sloboda mišljenja i izražavanja. Ljudska prava i slobode štite se putem institucija određenog političkog sustava. Sloboda mišljenja i izražavanja spada u osobna prava i slobode čovjeka, koje se nalaze u središtu zaštite u Republici Hrvatskoj. Pravo na slobodu izražavanja je iznimno bitno jer predstavlja pretpostavku za ostvarenje i zaštitu drugih prava i temeljnih sloboda. Također je bitno i za razvoj demokracije, te za razvoj slobode i vladavine prava u demokratskom društvu. Sloboda mišljenja i izražavanja obuhvaća slobodu tiska i drugih sredstava priopćavanja, slobodu govora, slobodu javnog nastupa i slobodno osnivanje svih ustanova javnog priopćavanja. Navedene se slobode mogu ograničiti zakonom, u slučajevima kada to nalaže državna sigurnost, potrebe javnog reda, zdravlja ili morala.
Abstract (english)
Every modern democratic society should strive to respect human rights and freedoms, including freedom of opinion and expression. They are protected through the institutions of a particular political system. Freedom of opinion and expression is one of the personal rights and freedoms of a man, which are the center of protection in the Republic of Croatia. The right to freedom of expression is extremely important because it is a prerequisite for the exercise and protection of other rights and fundamental freedoms. Also, it is important for the development of democracy, freedom and the rule of law in a democratic society. Freedom of opinion and expression includes freedom of the press and other means of communication such as freedom of speech, freedom of public appearance and the free establishment of all institutions of public communication. These freedoms may be restricted by the law in cases when it is require by the state security, public order, health or morals.
