Abstract
Dobrobit je u inačici najbolji interes djeteta koje je jedno od osnovnih načela postupanja s djecom u Konvenciji o pravima djeteta UN-a. Sadržaj pojma dobrobiti djeteta je usko vezan s pojmom interes djeteta, no u pravnoj se teoriji smatra primjerenijim i sveobuhvatnijim pravnim izrazom. Određivanje dobrobiti djeteta usmjereno je na utvrđivanje optimalnoga statusa djeteta s obzirom na njega samoga i druge subjekte, pri čem prosudba dobrobiti djeteta ovisi o njegovoj dobi i zrelosti te okolnostima slučaja. Za određivanje dobrobiti djeteta bitno je dugoročno sagledavanje onoga što je za dijete najbolje, tako da se uspostavi sklad s njegovim naknadnim prosudbama o tom kad odraste i kad bude odlučivalo samo o sebi i svojim pravima. S obzirom na zahtjev iz Konvencije o pravima djeteta, države su dužne zakonodavnim i upravnim mjerama osigurati zaštitu i skrb potrebnu za dobrobit djeteta. Konvencija o pravima djeteta odlučuje što je najbolji djetetov interes (Pravni leksikon).
Abstract (english)
The best interests oft he child, one oft he basic principles od dealing with children in the UN Convention on the Rights od the UN, are well-being. The content oft he concept od child welfare is closely linked to the notion od the childs interest, but is considered a more appropriate and more comprehensive legal expression in legal theory. The determination od the welfare oft he child shall be aimed at determining the optimal child status with refard to himself and other entities, when assessing the welfare od the child depends on his age and maturity and the circumstances of the case. In order to determine the well-being of the child, the long-term review of what is best for the child is to establish a harmony with its subsequent judgements oft he child when he grows up and decides only about himself and his rights. In view of the application of the Convention of the Rights of the Child, Member States shall provide for the protection and care necessary for the benefit oft he child by legislative and administrative measures. The Convention on the Rights od the Child shall decide on the best interests oft he child.
