Abstract
Radni odnos zasniva se na građanskopravnom ugovoru u formi trajne obveze koja vremenom prestaje. Postoje različiti načini prestanka radnog odnosa. Mnogi radni odnosi završavaju vremenskim ograničenjem. Radni odnos prestaje smrću zaposlenika, budući da je obavljanje posla izrazito osobna obveza koju ne mogu preuzeti nasljednici. Uobičajena zabluda je da mnogi ljudi vjeruju da će radni odnos završiti kada osoba dosegne standardnu dob za umirovljenje, automatski prestati na kraju mjeseca u kojem osoba dosegne tu dobnu godinu. To vrijedi samo ako je odgovarajuća klauzula uključena u ugovor o radu ili ako je to predviđeno ugovorom o radu ili kolektivnim ugovorom. U tim slučajevima s tim datumom automatski prestaje radni odnos. U suprotnom radni odnos mora prestati sporazumnim otkazom.
Abstract (english)
The employment relationship is based on a civil law contract in the form of a permanent obligation that ends over time. There are different ways to terminate an employment relationship. Many working relationships end with a time limit. The employment relationship ends with the death of the employee, since performing work is a highly personal obligation that cannot be assumed by heirs. A common misconception is that many people believe that employment will end when a person reaches the standard retirement age, automatically ending at the end of the month in which the person reaches that age year. This applies only if the corresponding clause is included in the employment contract or if it is provided for in the employment contract or collective agreement. In these cases, the employment relationship automatically ends on that date. Otherwise, the employment relationship must end by mutual termination.
