Abstract
Svaki se pravni poredak sastoji od niza uzajamno povezanih pravnih normi. Tumačev je zadatak te brojne i raznolike norme primijeniti na konkretan slučaj. Tumačenje u pravu provode pravnici praktičari i akademski pravnici. Različiti su razlozi za tumačenje pravnih normi. O pravnim praznima govorimo kada pravna norma uopće ne postoji. Za popunjavanje pravnih praznina najčešće se koristi analogija. Svaki pravni sustav teži biti koherentan. Zato se moraju ukloniti antinomije. Temeljna norma pravnog sustava je načelo zakonitosti, koje kaže da svi pravni akti državnih i drugih subjekata, kao i njihove pravne radnje, moraju i formalno i materijalno biti usklađeni s višim pravnim normama, i koje propisuje sankcije protiv akata i radnji koji to načelo zakonitosti ne poštuju.
Abstract (english)
The legal order consists of a series of interconnected legal norms. The task of the interpreter is to apply these numerous and diverse norms to a specific case. Legal interpretation is carried out by legal practitioners and academic lawyers. There are different reasons for interpreting legal norms. We speak of legal gaps when a legal norm does not exist at all. An analogy is most often used to fill legal gaps. Every legal system tends to be coherent. That is why antinomies must be removed. The principle of legality is a fundamental norm of the legal system that requires that all legal acts of state and other entities, as well as their legal actions, be formally and materially harmonized with higher legal norms that regulate the same relationships, prescribing sanctions against acts and actions that do not comply with this requirement.
