Abstract
Odmjeravanje kazne je postupak u kojem sud utvrđuje i izriče određenu sankciju počinitelju, nakon što utvrdi njegovu krivnju. U obrazloženju presude, sud je dužan navesti koje je okolnosti uzeo u obzir pri odmjeravanju i kojim se razlozima vodio prilikom odmjeravanja kazne. Već sam Zakon odmjerava kaznu tako što za svako kazneno djelo predviđa posebni kazneni okvir, odnosno donju i gornju granicu kazne koja se može izreći za to kazneno djelo. U kaznenom zakonu Republike Hrvatske navode se tri temelja za odmjeravanje kazne: stupanj krivnje, pogibeljnost i svrha kažnjavanja. Olakotne i otegotne okolnosti mogu utjecati na to da kazna bude veća ili manja. Zabranjuje se dvostruko vrednovanje okolnosti važnih za odmjeravanje kazne. Zakon sudu daje mogućnost ublažavanja kazni, a razlikujemo zakonsko i sudsko. Sud se može odlučiti za oslobođenje od kazne pod određenim pretpostavkama prilikom odmjeravanja kazne. Odmjeravanje kazne pod određenim pravilima sud provodi za kaznena djela u stjecaju i osuđenim osobama.
Abstract (english)
Sentencing is a procedure in which a court establishes and imposes a specific sanction on a perpetrator after finding his guilty plea. In the reasoning of the judgment, the court is obliged to state which circumstances have been taken into account in the deliberation and what reasons led to the imposition of the sentence. The law already directs the sentence by forcing each criminal offense into a special criminal law, ie the lower and upper limits of a sentence that can be imposed for the offense. In the Criminal Code of the Republic of Croatia there are three grounds for measuring the sentence: degree of guilt, fatality and purpose of punishment. Overture and excessive circumstances can affect whether the sentence is bigger or smaller. It is forbidden to double the assessment of the circumstances relevant to the punishment of penalties. The law gives the court the possibility of mitigating penalties, and we differentiate between legal and judicial. The court may decide to be released from punishment under certain presumptions when measuring the sentence. Determining the sentence under certain rules is conducted by the court for the criminal offenses in the acquittal and convicted persons.
