Abstract
Suvlasništvo nastaje između dvije ili više osoba na jednoj realno nepodjeljivoj stvari gdje je svaki dio idealno određen. Svaki suvlasnik ima pravo na razvrgnuće suvlasništva bez obzira na to koliki mu jesu vlasnički dio, te bez obzira na to jesu li ostali suvlasnici s tim sporazumni ili se protive razvrgnuću. Kada suvlasnik zahtjeva da se stvar podijeli između suvlasnika i da se prekine suvlasništvo, tada govorimo o razvrgnuću suvlasničke zajednice. Pravo na razvrgnuće je preobražajno pravo koje proizlazi iz suvlasnikova prava vlasništva i međusobnih odnosa suvlasnika iste stvari. Do raskida suvlasništva može doći na dva načina i to dobrovoljno i sudskim putem, sve ovisi o volji i dogovoru suvlasnika. Svaki suvlasnik ima pravo zahtijevati razvrgnuće osim ako to nije na štetu drugog suvlasnika.
Abstract (english)
Co-ownership arises between two or more people at real undistributable side where every part is ideally specified. Every co-owner has a rigt to cancel co-ownership no matter how large is his part and no matter if all of co-owners agree or they are against that. If co-owner require to share something between co-owners then to cancel their co-ownership then we talk about dissolutioning co-owners association. Right to dissolution is transformation right which comes from co-owners property right and mutual co-owners relation of the same thing. There are two different ways to abort co-ownership, voluntarily and judiciary, it depends on co-owners will and their agreement. Every co-owner has a right to require a dissolution only if that won`t damage the other co-owner.
