U tom su smislu, Kaznenim zakonom propisana i kaznena djela protiv Republike Hrvatske. Kod ovih kaznenih djela štiti se ustavno uređenje i sigurnost Republike Hrvatske kao samostalne, demokratske i suverene države. Konkretnije, štiti se opstojnost Republike Hrvatske inkriminiranjem veleizdaje, priznavanja okupacije i kapitulacije, nadalje štiti se i sigurnost te obrambena moć Republike Hrvatske inkriminiranjem sprječavanja borbe protiv neprijatelja, službe u neprijateljskoj vojsci, pomaganja neprijatelju, podrivanja vojne i obrambene moći države, odavanja tajnih podataka te špijunaže. Također se štite i najviši dužnosnici Republike Hrvatske inkriminiranjem prisile protiv najviših državnih dužnosnika, a vidljiva je i zaštita dostojanstva Republike Hrvatske inkriminiranjem povrede ugleda države. Svaka osoba može biti počinitelj najvećeg broja navedenih kaznenih djela, no kod nekih kaznenih djela, zbog njihove same prirode, kao što su kazneno djela sprječavanja borbe protiv neprijatelja, kazneno djelo službe u neprijateljskoj vojsci, kazneno djelo pomaganja neprijatelju, počinitelj može biti samo građanin Republike Hrvatske. Za određena kaznena djela kao što su ranije spomenuta kaznena djela sprječavanja borbe protiv neprijatelja, službe u neprijateljskoj vojsci, te pomaganja neprijatelju, važno je obilježje vrijeme njihova počinjenja jer će navedeno djelo postojati samo ako je počinjeno u vrijeme rata ili oružanog sukoba u kojemu sudjeluje i Republika Hrvatska. U odnosu na Kazneni zakon iz 1997. godine, sužen je obujam kaznenih djela protiv Republike Hrvatske što se tiče pripremnih radnji, te je prema sadašnjem Kaznenom zakonu kažnjivo pripremanje kaznenog djela veleizdaje, sprječavanja borbe protiv neprijatelja i podrivanje vojne i obrambene moći države.
Abstract (english) According to past criminal laws there is no strict definition of a criminal offense, it can be most easily defined as the conduct of an individual that is punishable, and is explicitly prescribed by law as a criminal offense. In this sense, Criminal Code prescribes criminal offenses against the Republic of Croatia. In these criminal offenses the constitutional order and security of the Republic of Croatia is protected as an independent, democratic and sovereign state. More specifically, it protects the survival of the Republic of Croatia by incriminating the proclamation, recognition of occupation and capitulation, further protecting the security and defensive power of the Republic of Croatia by incriminating the fight against the enemy, serving in the hostile army, helping the enemy, defeating military and defense powers of the state and espionage. The highest officials of the Republic of Croatia are also protected by the incrimination of coercion against the highest state officials, and the protection of the dignity of the Republic of Croatia is also visible through the incrimination of the violation of the state's reputation. Any person may be the perpetrator of most of the aforementioned criminal offenses, but in some criminal offenses, because of their very nature, such as the criminal offenses of preventing the fight against the enemy, the criminal offense of service in the host army, the criminal offense of aiding the enemy, the perpetrator, only can be a citizen of the Republic of Croatian. For certain criminal offenses such as the aforementioned: criminal offenses for preventing the fight against the enemy, serving in the hostile army, and assisting the enemy, the time of their perpetration is an important feature, since the act will only exist if it is committed during the war or armed conflict in which it participates Republic of Croatia. In relation to the Criminal Code of 1997, the volume of criminal acts against the Republic of Croatia has been narrowed as far as preparatory actions are concerned. According to the current Criminal Code, it is punishable to prepare a criminal offense of prostitution, preventing the fight against the enemy and undermining the military and defensive power of the state.
