Abstract
Zbog zaštite ravnopravnosti gospodarskih subjekata na tržištu, zakonitog i uspješnijeg funkcioniranje javnih službi, unaprjeđivanja upravljanja javnim financijama, sprječavanja korupcije, postoji potreba za legislativnim uređenjem javne nabave u Republici Hrvatskoj. Javna nabava je prvi puta legislativno uređena 1997 godine i od tada se sve više razvijala i prilagođavala Europskoj pravnoj stečevini, kojoj je danas potpuno usklađena. Okvirni sporazum se prvi puta javlja 2007 godine zbog potrebe da se skrati vrijeme i administrativno opterećenje naručitelja i ponuditelja kada postoji potreba za sklapanjem više ugovora o javnoj nabavi u određenom vremenskom razdoblju. Tokom vremena otvoreni postupak javne nabave pokazao se kao najprikladniji za ponuditelje i za naručitelje, pa je tako danas najviše korišteni postupak javne nabave.
Abstract (english)
There is a need for legislative regulation of public procurement in the Republic of Croatia in order to protect the equality of economic entities on the market, the lawful and successful functioning of public services, the improvement of public financial management, and the prevention of corruption. Public procurement was first regulated by law in 1997 and since then it has developed and conformed to the EU acquis, with which it is nowadays fully in line. A framework agreement was introduced in 2007 in order to reduce time and administrative burden of both parties when there is a need to conclude several public procurement contracts over a given period of time. Over the years the open public procurement procedure has proven itself to be the most suitable one for both the ordering and offering party and the one that is most widely used nowadays.
