The importance of managing the marital assets obtained during the course of the marriage is primarily reflected in the institution of marriage and property, and then in the ownership, i.e. co-ownership. The existence of a marriage is the prerequisite of the occurrence of the spouses’ joint property of which they become co-owners in equal parts unless otherwise is determined by a prenuptial contract. Spouses can define the management of their own marital assets prior to entering into marriage, during the course of the marriage, as well as on the occasion of terminating the marriage. The form of managing the marital assets prior to entering into marriage shall be ensured by means of concluding a prenuptial contract, a namely marital contract if it is entered into during the course of the marriage. Contrary to this, when it comes to termination of the marriage, the most common form of organisation and division of the marital assets is regulated by law. In practice, it is resolved by a contract of the division of marital property and it is agreement based. With regard to the cases where the spouses cannot reach an agreement by mutual consent on splitting the marital assets, the decision shall be left to the competent court.
