Abstract
Tema ovog završnog rada je institut izvlaštenja u hrvatskom pravnom sustavu. Institut izvlaštenja specifičan je institut, prisutan od najranijih vremena, kojim država prisilom zadire u ustavom zajamčeno pravo vlasništava. U radu se definira koje su pretpostavke pod kojima može uslijediti oduzimanje ili ograničenje prava vlasništva sukladno normama važećeg pravnog poretka. Izvlaštenje u Republici Hrvatskoj je uređeno Zakonom o izvlaštenju i određivanju naknade kao općim zakonom koji se... More upotrebljava u svim postupcima izvlaštenja. U radu se pobliže objašnjava izvlaštenje, predmet izvlaštenja, vrste izvlaštenja, tko su korisnici izvlaštenja te koja je njegova svrha. Također, objašnjavaju se temeljne pretpostavke koje moraju biti ispunjene da bi se postupak izvlaštenja mogao provesti, a to su postojanje vlasništva, utvrđivanje interesa Republike Hrvatske i određivanje naknade. Na kraju rada uspoređuje se Zakon o izvlaštenju i određivanju nakade sa Zakonom o izmjenama i dopunama Zakona koji se stupio na snagu ove godine. Less
Abstract (english)
The topic of this final paper is the institute of expropriation in the Croatian legal system. The institute of expropriation is a specific institute, present from the earliest times, by which the state forcibly extends into the property right guaranteed by the Constitution. This paper will define what are the assumptions under which the property right can be taken or limited according to the norms of the legal order in force. In the Republic of Croatia expropriation is regulated by... More the Expropriation and Determining of Compensation Act as a general act used in all expropriation procedures. Furthermore, the expropriation, the object of expropriation, the types of expropriation, the users of expropriation, and its purpose will be explained in detail. In addition, the basic prerequisites that have to be met in order to complete the expropriation procedure will be explained, including the property title, establishing the interest of the Republic of Croatia and determining of compensation. At the end of the paper the Expropriation and Determining of Compensation Act will be compared to the Act on the Amendments to the Expropriation and Determining of Compensation Act that entered into force this year.
