Abstract
Javni sektor može se definirati kao niz različitih i heterogenih djelatnosti, u okviru kojih se zadovoljavaju potrebe i interesi građana, koje država definira zakonima, kojima se u pravilu razdražuju ustavna prava i slobode građana, te njihovi interesi. Popis djelatnosti kojima se u okviru javnog sektora zadovoljavaju potrebe građana poprilično je dugačak. Neke od najznačajniji djelatnosti su zdravstvo, komunalne usluge, kultura, sport, infrastrukturne usluge i slično. S obzirom na važnost koju djelatnosti javnog sektora imaju u svakodnevnom životu građana, razuman je zaključak da rad javnog sektora treba biti javan, odnosno da građanima trebaju biti dostupne informacije koje se tiču poslovanja javnog sektora, a nisu označene kao određena vrsta tajne. Načelo javnosti podrazumijeva osiguranje nesmetane mogućnosti pristupu informacijama, uvidu u način poslovanja tijela javnog sektora i druga pitanja koja su od područja interesa za građane, a nisu zakonima ili drugim aktima označeni tajnima. Kao jedno od temeljnih ustavnih načela, načelo javnosti treba se i mora poštivati u poslovanju javnog sektora.
Abstract (english)
The public sector can be defined as a series of various and heterogeneous services within which the needs and interests of the citizens are met. These services are defined by the law of the of services which meet the needs of citizens within the public sector is fairly long. Some of the most important services the public sector includes are healthcare, public utilities, culture, state which generally excite the constitutional rights, freedoms of citizens and their interests. The list sports, infrastructure, etc. Given the importance that the public sector services have in the everyday lives of the citizens, a reasonable conclusion is that the public sector work should be public, and that the citizens should have access to the information regarding the public sector work, since it is not marked as classified. The visibility principle implies providing an unrestricted access to information, access to way of conducting business of public sector bodies, and other issues that are of interest to citizens but are not marked as classified by law or other acts. As one of the fundamental constitutional principles, the visibility principle should and must be respected in the public sector business.
